2. User Responsibilities and Conduct

2.1. Photo Submission: You are responsible for uploading a clear, well-lit photo taken against a neutral background that meets the basic requirements for processing. The quality of the final photo is highly dependent on the quality of the original photo you provide. Our AI can make many corrections, but it cannot fix severely blurry, dark, or otherwise unsuitable images.

2.2. Lawful Use: You agree to use the Service only for lawful purposes. You warrant that you are the legal owner of the photograph you upload or have obtained all necessary permissions and rights to use it. You agree not to upload any content that is illegal, offensive, harmful, or infringes on any third-party rights.

2.3. Age Requirement: You must be at least 16 years of age to use our Service. By using the Service, you represent and warrant that you meet this requirement.

3. Payments and Refund Policy

3.1. Our Commitment to Quality: We are dedicated to providing you with high-quality biometric photos that meet strict official requirements for documents like passports and visas. Our primary goal is your complete satisfaction and a successful application. The success of the final photo is highly dependent on the quality of the original picture you provide. We strongly recommend you review our photo guidelines carefully before uploading your image to ensure the best possible result.

3.2. Our Guarantee: Acceptance by Authorities:

  • We guarantee that photos generated by our service will meet the official biometric standards required for your application, provided you have followed our guidelines when taking and submitting your photo.
  • If your passport or visa application is rejected by a government agency specifically due to the photo we provided, you are eligible for either a full refund of your purchase price or a new, corrected photo at no additional charge.
  • Requirement: To process this claim, you must provide us with a copy of the official rejection letter or notice from the authorities. This documentation must clearly state that the photo was the reason for the rejection.

3.3. When You Are Eligible for a Full Refund:

You may be eligible for a full refund under the following circumstances:

  • Rejection by Authorities: As stated in our guarantee above, if the photo is officially rejected.
  • Technical Failures: If a technical error or system glitch on our end prevents you from successfully generating or downloading your photo, and our support team cannot resolve the issue within two (2) business days.
  • Duplicate Orders: If you were accidentally charged twice for the same order due to a payment processing error.

3.4. When Refunds Are Not Issued:

A refund will not be provided in the following situations:

  • Unsuitable Original Photo: If the final processed photo is non-compliant because the original image you uploaded did not meet our stated requirements (e.g., poor lighting, incorrect background, improper facial expression, non-centered angle, etc.).
  • Change of Mind: We cannot issue refunds if you simply decide you no longer need the photo after the service has been rendered.
  • User Error: Issues arising from user error, other than those explicitly covered in this policy.

3.5. How to Request a Refund:

  • Provide Details: In your email, please include your order number, the email address used for the purchase, and a clear explanation of the issue.
  • Submit Proof: Attach any required documentation, such as the official rejection letter or screenshots demonstrating a technical error.
  • Our team will review your request and the provided evidence. We will notify you of our decision and, if approved, process your refund within 7-10 business days. The refund will be credited to your original method of payment.

4. Digital Delivery

4.1. Our product is delivered digitally. Upon successful payment, you will be able to instantly download your high-resolution digital photo sheet from our website.

4.2. A copy of your photo sheet will also be sent to the email address you provide during the checkout process. If you do not receive the email, please check your spam or junk mail folder before contacting support.

4.3. We do not provide physical photo printing or shipping services.

5. Intellectual Property

5.1. Our Intellectual Property: The Service and all materials therein, including, without limitation, the software, AI technology, website design, text, graphics, and logos ("Company IP"), are the exclusive property of PassportPhotoGenie and its licensors and are protected by intellectual property laws.

5.2. Your Intellectual Property: You retain full ownership and all intellectual property rights to the original photograph you upload to the Service ("Your Content").

5.3. License You Grant to Us: By uploading Your Content, you grant PassportPhotoGenie a limited, temporary, non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and create derivative works from Your Content. This license is granted for the sole purpose of providing the Service to you, i.e., generating your compliant photo. This license automatically terminates once the Service has been rendered and your final photo has been delivered.

5.4. License We Grant to You: Upon full payment for the Service, we grant you a perpetual, non-exclusive, worldwide license to use the final, processed photo product for your personal, official, and non-commercial purposes.

6. Disclaimer of Warranties and Limitation of Liability

6.1. The Service is provided on an "as is" and "as available" basis. Except for the guarantee expressly stated in our Refund Policy, we make no other warranties, express or implied, regarding the Service.

6.2. PassportPhotoGenie's liability for any claims related to our services is strictly limited to the amount you paid for the service in question. We are not responsible for any indirect, consequential, or incidental damages resulting from the use of our service, including but not limited to application fees, travel costs, or processing delays.

7. Privacy
